By accessing and using Brisbane Pets ("the Directory", "we", "us", or "our"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Directory.

2. Description of Service

Brisbane Pets is a business directory service that connects users with local businesses in Brisbane. We provide a platform for businesses to list their services and for users to discover and contact these businesses.

3. User Conduct

You agree not to:

  • Use the Directory for any unlawful purpose or in violation of any applicable laws
  • Submit false, misleading, or fraudulent information
  • Impersonate any person or entity
  • Interfere with or disrupt the Directory or servers
  • Attempt to gain unauthorised access to any part of the Directory
  • Scrape, harvest, or collect information from the Directory without permission
  • Use automated systems to access the Directory in a manner that exceeds reasonable use

4. Business Listings

4.1 Submission

Businesses may submit listings to the Directory. By submitting a listing, you represent and warrant that:

  • You have the authority to represent the business
  • All information provided is accurate and complete
  • The listing does not infringe on any third-party rights
  • The business operates lawfully in its jurisdiction

4.2 Listing Tiers and Payment

We offer different listing tiers with varying features and visibility. Payment for premium listings is processed through Stripe. All payments are in Australian Dollars (AUD) unless otherwise specified.

4.3 Refunds

Listing fees are non-refundable once the listing has been published. If you believe you have been charged in error, please contact us within 14 days of the charge.

4.4 Removal

We reserve the right to remove, edit, or refuse any listing at our sole discretion, including but not limited to listings that:

  • Violate these Terms of Use
  • Contain inaccurate or misleading information
  • Promote illegal activities
  • Receive verified complaints from users

5. Affiliate Program

Our affiliate program allows participants to earn commissions by referring businesses to the Directory. Participation is subject to:

  • Accurate disclosure of affiliate relationships where required by law
  • Prohibition of self-referrals or fraudulent referral activity
  • Compliance with applicable advertising and marketing laws
  • Our right to terminate affiliate accounts for violations

6. Intellectual Property

The Directory and its original content, features, and functionality are owned by us and are protected by Australian and international copyright, trademark, and other intellectual property laws.

Business listings remain the intellectual property of their respective owners. By submitting a listing, you grant us a non-exclusive, royalty-free licence to display and promote your listing on the Directory.

7. Disclaimer of Warranties

The Directory is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

  • The Directory will be uninterrupted or error-free
  • Information on the Directory is accurate, complete, or current
  • Any business listed on the Directory will meet your requirements
  • Results obtained from using the Directory will be accurate or reliable

We do not endorse, guarantee, or assume responsibility for any business listed on the Directory. Users should conduct their own due diligence before engaging with any listed business.

8. Limitation of Liability

To the maximum extent permitted by Australian law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from:

  • Your use of or inability to use the Directory
  • Any conduct or content of any third party on the Directory
  • Unauthorised access, use, or alteration of your content
  • Any transactions between you and businesses listed on the Directory

9. Indemnification

You agree to indemnify, defend, and hold harmless Brisbane Pets, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Directory or violation of these Terms.

10. Third-Party Links

The Directory may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of these external sites.

11. Modifications to Terms

We reserve the right to modify these Terms of Use at any time. Changes will be effective immediately upon posting to the Directory. Your continued use of the Directory after changes are posted constitutes acceptance of the modified terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Queensland, Australia, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Queensland.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
